New law cannot come soon enough for children

The final section of the Children and Families Act 2014 was made law on 22 October 2014 and deals with parental involvement.  There is now a presumption in the family courts that the welfare of children is best served by both parents being involved in their future lives, providing it is safe.  It is hoped that this new emphasis will encourage all separating parents to put the needs of the children above their own needs and come to amicable arrangements where they are both fully involved in their children's lives.

All too often following separation children lose touch with the parent they no longer live with and this can have lasting and devastating affects on no only their childhood but the scars can live with them for the rest of their lives.  When couples separate the children often blame themselves and when they then no longer see one of their parents this can be compounded further.  They can suffer a real sense of loss and find themselves without a voice, particularly if their parents are very acrimonious in their dealings with each other.

This is where mediation can be so helpful to separating parents as it enables them to have sensible discussions in a safe and supported environment and both have a voice in their children's future.  As a family mediator I often encourage parents to enter into a co-parenting agreement within the mediation so that all issues are covered and not only the time they each spend with the children.  This encourages parents to consider all of the issues that surround their children and develop a strategy of how they will deal with these issues as and when they arise.
